That depends on multiple things, like whether there's an outstanding warrant for McEachern's murder and if there is, whether or not Christmas still has the same legal name as the one on the warrant. If he changed his name back to Christmas, there's very little chance that he would be charged for McEachern's death, seeing as he's technically not Joe McEachern. Long story short, there's a lot of technicalities to consider.
I have to agree with Anna. Christmas can be guilty for Mrs. Burdens death but since he changed his name, he might not get charged for McEachern's death.
i believe it would've been to easy to just send Christmas to prison and seperate him from the rest of the characters this is probably why he is kept in contact with the characters and outside of prison
